The turbulent litigation between Axel Rose and Irving Azoff has lead to the possibility of a referee. The judge said this might be necessary if both sides cannot act reasonable. Recent deposition was suspended after Azoff reportedly threw a copy of the Wall Street Journal at Rose’s attorney. The court has placed the blame on both individuals and has stated the expensive repercussions for such extreme positions. Azoff’s management company sued the singer $1.8 million for unpaid commissions. Roses quickly filed a counter suit blaming Azoff for not promoting Chinese Democracy sufficiently and lying about the potential for a tour with Van Halen.

Guns ‘N Roses front man Axl Rose has filed a $5 million lawsuit against former manager Irving Azoff and his company Frontline Management. The suit accuses Azoff with breach of fiduciary duty, fraud and breach of contract. Rose claims Azoff set the current incarnation of Guns ‘N Roses up for deliberate failure and improper marketing of the bands latest release ‘Chinese Democracy’. Rose believes this attempt at sabotage was done with the intention of using the failure as leverage for Rose to reunite with the bands original members. Rose further accuses Azoff of failing to pursue legal action against Activision for the use of “Sweet Child O’ Mine” in Guitar Hero 3.
This suit comes months after Front Line Management filed against Rose for unpaid commissions on overseas performances. The company is entitled to a 15% cut of the bands earnings and claims it is entitled nearly $2 million dollars. This further intensified personal issues between Azoff and Rose due to Azoff’s filing court documents using Rose’s adopted name, William Bailey. Rose claims this was done deliberately with the intention to cause emotional harm. Azoff is evidently aware of the emotional baggage that the name carries for Rose due to past personal conversations between the two. William Bailey does not appear in any of Rose’s legal documents.
